Therefore when sending an email user tracking is automatically on, even when the [usertrack] placeholder is not present in the email. See file sendemaillib.php line 365.
This seems the wrong way round. It should be off by default and also should be documented in config.php with a value of 0.

yes, it should go in config, but I'd keep it 1 in init anyway.
